Southport decided to move the discussion of this forum and leave a message on the Cheshunt on for me and others to see. this was reported and the message content deleted.

If Southport wishes to contiune digging people out and leaving little snide remarks then southport has to expect the fall out.

So, if this can be avoided then we are better safe than sorry.

[color:"blue"] Gonzo, Please keep up, I have explained what I mean. It makes no odds which forum you write libelous comments on. If its libel, its libel. There is no valid reason for ETFC to not have their own forum, Just a Big Brother attitude. Comments about an ETFC forum must touch a nerve, cos there is always a rush of replies. One final point, I don't know where you get it that I am 'bitter'. Bitter about what? Seems to me that most of the bitterness on OUR forum comes from ETFC fans. If you want to call it bitterness, because we have the audacity to reply to certain people who are intent on stirring things up, then so be it. Perhaps you should go back to the start of this thread, and see which clubs supporter started it, and on which clubs forum it was started. [/color]

hollie, the key to this issue os that if there is an ETFC forum and libeloue comments are posted on it then the club could be sued for libel by association. As the ESL forum is more generalist, the club is exonerated of any libelous postings as it has absolutely no control over comments made. Of course, a third party may want to sue any individual poster over any comments made but ETFC would not be associated with this. I think and hope that clarifies the point.

Thanks Happy, that's the point exactly. Hollie, as you so eloquently put it 'libel is indeed libel'. However, the point is one of association. In other words, who can be held liable for libel. The poster of any defamatory remark would obviously be liable, but so may those who operate the forum. Its just like a newspaper being liable for defamatory comments written by one of it's reporters - the newspaper is potentially liable as it has permitted the comments to be published.

The 'bitterness' is evident in your replies. We have quite happily put up with 'pub team' jibes over the last 2 years. SOME of you unfortunately can't cope with the fact that Enfield Town is fast becoming a much bigger club than EFC and rather than wishing us well, seem to take every opportunity to knock our achievements. And so, when an ETFC fan lobs a bit of banter your way it clearly strikes a nerve. I hasten to add that the majority of EFC posters here (russ, MK et al) recognise what we have achieved and that EVERYONE made very tough decisions when ETFC was formed. We're not traitors. We're fans who have made the best of a bad situation.

you will find any unwelcome comments on the cheshunt forum again will be deleted so yes you can post anywhere but your comments are being monitored.

as for moving on, you know the only real way to move on is not come on this forum at all.
